Terms of Use

These terms govern your use of Cold Callz, operated by Final Exchange LLC. They are provided for transparency and are not legal advice.
1. Agreement
By creating an account, accessing the app, or purchasing anything through our storefront, you agree to these Terms of Use. If you are accepting on behalf of a company, you confirm you are authorised to bind that company.
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity in your account. Workspace admins can invite, grant, restrict and remove access for teammates; the workspace owner is responsible for how their team uses the service.
3. Acceptable use
You agree not to:
Send unsolicited bulk email that violates the CAN-SPAM Act, CASL, GDPR/ePrivacy or any other applicable law, or to send email without a working unsubscribe path and accurate sender identity.
Place calls or texts in violation of the TCPA, state calling rules, or national and internal do-not-call lists, or to use recording features without the consent required in the relevant jurisdiction.
Record or transcribe a video meeting without notifying participants where notice or consent is required.
Upload or process data you have no lawful basis to process, or scrape, harvest or import data in breach of a third party's terms.
Reverse engineer, resell, sublicense or overload the service, bypass rate limits, or probe our security controls.
Use the service for unlawful, deceptive, harassing, infringing or malicious activity.
You are solely responsible for the content and compliance of the outreach you send.
4. Your data and our licence
You retain all rights to the data you put into the service. You grant Final Exchange LLC a limited licence to host, process, transmit and display that data solely to operate and support the service on your behalf. You represent that you have the rights and lawful basis needed for the personal data you upload.
5. Third-party services
Features such as payments, mail servers, video meetings, business search and AI assistance depend on third parties. Their availability, pricing and terms are outside our control, and your use of them may be governed by their own agreements.
6. Availability and changes
We aim for high availability but do not guarantee uninterrupted service. We may modify, add or remove features, and we may perform maintenance that briefly interrupts access.
7. Suspension and termination
We may suspend or terminate access for a material breach of these terms, for suspected abuse, or where required by law — generally after notice unless the situation is urgent. You may stop using the service at any time; on termination you can request an export of your data for a reasonable period before deletion.
8. Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that data enriched or generated by automated features (including AI drafts, website technology detection and business search results) is accurate or complete.
9. Limitation of liability
To the maximum extent permitted by law, Final Exchange LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data. Our total aggregate liability arising from or relating to the service is limited to the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or one hundred US dollars.
10. Indemnity
You will indemnify and hold harmless Final Exchange LLC and its officers and employees from claims, damages and expenses arising out of your data, your outreach, or your breach of these terms or of applicable law.
11. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally by contacting policy@finalexchange.com. Disputes not resolved informally will be brought in the state or federal courts located in Delaware, and each party consents to that jurisdiction.
12. Changes to these terms
We may update these terms; the effective date on this page will change and continued use after an update means you accept the revised terms.
